Pietro Barbaro S.p.A., through its legal representative pro-tempore, email: privacy@pietrobarbaro.com, as Data Controller, wishes to inform you that Regulation EU/2016/679 “General Regulations on Data Protection – GDPR”, replacing the “Privacy Code” – Legislative Decree n. 196/2003, provides for the protection of individuals with regards to the processing of personal data and that Pietro Barbaro S.p.A. has upgraded its systems to the guidelines provided by the mentioned GDPR. 

The provisions of this privacy policy are valid while visiting our website and when using other services connected to it.

In compliance with art. 13 of the Regulation EU/2016/679, this policy describes what type of data is collected and how it is treated by Pietro Barbaro S.p.A.

The type of personal data collected depends on the kind of relation you have with us, and the services we provide you. To this respect, we may collect the following personal details relevant to you:

  • Name and contact details, such as, for example, name and surname, e-mail address, address, and telephone number,
  • Information relevant to the computer, device or internet connection used, such as IP address, type, and version of the browser.

Purpose and legal basis of data processing

Bearing in mind that you can freely access and browse the website, the main purpose of the data collection is to enhance our websites’ user experience and respond to enquiries, for example through our Contact Form.

The treatment of your personal details is legally based on:

  • The treatment being necessary to satisfy our legitimate interest, for example to answer your enquiries, to increase the quality of our services, and for direct marketing (soft spam) by using the e-mail addresses previously provided to suggest similar services,
  • The treatment being necessary to comply with a legal obligation we are subjected to or otherwise legitimate, pursuant to the laws governing the protection of the applicable data.

On the basis of how you interact with us and our services, we may use your personal data for the following:

  • Manage relations between ourselves, for example providing and managing access to our services. This treatment is necessary for the execution of a contract.
  • Improve our services, for example by inviting you to take part in surveys or tailor your experience with our services. This treatment is a legitimate interest.
  • Marketing, for example sending you marketing or advertising communications which may be of your interest. This treatment occurs with your explicit consent.
  • Other general scopes supporting our activity, including but not limited to purchasing, financial, fiscal and risk management activities connected to compliance and external reporting. This treatment is necessary to comply with legal obligations we are subjected to or otherwise legitimate pursuant to the laws governing data protection or for our legitimate interest.

Methods of processing, storage, and security measures

The data collected are treated in compliance to the security obligations provided by the applicable laws to prevent loss, illicit or incorrect use of data and unauthorised access. Generally, Data is stored on servers physically located in Italy.

Your personal information shall be treated only to the extent necessary to comply with our obligations and for the time necessary to achieve the purposes for which the data is collected, in compliance with our data storage policies and the applicable laws on data protection. When the data ceases to be of interest to us, we shall adopt all reasonable measures to delete them from our system and records or correctly make them anonymous so that they cannot in any way be linked to you.  

Subscription to the newsletter and the relevant treatment are deemed valid until you unsubscribe using the provided link, or after 12 months after the last evidenced documented interaction (click, open, reply).

Data security is for our company an overriding priority: we use, in fact, a data encryption system (SSL) on the data you provide.

Communication and disclosure

To provide the best service, promote our commercial operations and correctly comply with contractual, pre-contractual or post-contractual obligations (e.g.: technical assistance or support request or claims pertaining services), we may disclose some of the data internally or with selected third parties.

Third parties we may share the information are:

  • Consultants and/or partners, freelancers (individual or in associated form) providing legal, tax or auditing services.

  • Companies, entities, associations carrying out credit protection activities.

The interested party can request the list of external parties who carry out privacy management activities as appointed by the Controller pursuant to art. 28 of the Reg. EU/2016/679.

Exercising rights

You may exercise your rights towards the Data Controller by contacting us at any time with enquiries on your personal data using the e-mail: privacy@pietrobarbaro.com (right to request to the Data Controller the amendment, cancellation, limitation or opposing the treatment of the personal details and the right to the portability of personal details) as provided by Chapter III of the Regulation EU/2016/679.

Should the Data Controller not provide any feedback within 30 days from your request, or should you experience a violation of your rights, you may address the competent Data Protection Authority pursuant to art. 77 of Regulation EU/2016/679.
